Labor Market Impact Assessment (LMIA)

A Labor Market Impact Assessment (LMIA) is a document that an employer in Canada may need to get before hiring a foreign worker. A positive LMIA will show that there is a need for a foreign worker to fill the job. It will also show that no Canadian worker or permanent resident is available to do the job. A positive LMIA is sometimes called a confirmation letter.    

Employer side requirements for LMIA;

• Be actively engaged in a business
• Must prove can not hire Canadian Citizen or PR.
• The company must not be sex industry related or on the non-compliance list.
• Must cooperate with on-site inspection, if any.
• Must pay employee same or higher pay agreed on Offer of employment.
• Any changes in the work condition, requires a new work permit.
• Voluntarily disclose information to ESDC, if not sure about anything 

Employee side requirements for LMIA;

Once an employer gets the LMIA, the worker can apply for a work permit. To apply for a work permit, a worker need;

• A Job offer letter
• A Contract
• A copy of LMIA and
• The LMIA number
